NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF THE HOUSING ACT 1966 AND THE THIRD SCHEDULE THERETO AS EXTENDED BY SECTION 10 (INSERTED BY SECTION 86 OF THE HOUSING ACT 1966) OF THE LOCAL GOVERNMENT (NO 2) ACT 1960 AS AMENDED BY SECTION 222 OF THE PLANNING AND DEVELOPMENT ACT 2000 AND UNDER AND BY VIRTUE OF SECTIONS 213 & 214 OF THE PLANNING AND DEVELOPMENT ACT 2000

 

PUBLISHED IN ACCORDANCE WITH ARTICLE 4(a) OF THE THIRD SCHEDULE OF THE HOUSING ACT 1966

 

COMPULSORY ACQUISITION OF LAND

 

SOUTH DUBLIN COUNTY COUNCIL COMPULSORY PURCHASE

(Ninth Lock Road Nangor Road) ORDER 2006

 

South Dublin County Council (hereinafter referred to as the local authority) in exercise of the powers conferred upon them by Section 76 of the Housing Act, 1966 and the Third Schedule thereto, as extended by Section 10(inserted by section 86 of the Housing Act, 1966) of the Local Government (No.2) Act, 1960 as amended by Section 222 of the Planning and Development Act, 2000, and under and by virtue of Sections 213 & 214 of the Planning and Development Act 2000 have made an order entitled as above which is about to be submitted to An Bord Pleanla for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the land described in the First Schedule hereto for the purposes of the construction of a road improvement scheme, and all ancillary works associated therewith, plot nos. 1,2,3 & 4 are totally contained within the Townland of Clondalkin, and extend from the junction of the Nangor Road and the Ninth Lock Road southward for 147 metres (approx) and westward for 100 metres (approx).

 

Owners, lessees and occupiers of the land described in the Schedule will receive individual written notice.

 

The Board cannot confirm a Compulsory Purchase Order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn, until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who held the oral hearing.

 

Any objection to the Order must state in writing the grounds of objection and be sent addressed to An Bord Pleanla at 64 Marlborough Street, Dublin 2, so as to reach the said Board before 18th September 2006.

 

A copy of the Order and the map referred to in it may be seen at all reasonable hours at the offices of South Dublin County Council, County Hall, Town Centre, Tallaght, Dublin 24 and also Civic Offices, Ninth Lock Road, Clondalkin, Dublin 22. Schedule

PART 1

Land other than land consisting of a house or houses unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense.

 

The area to which the order refers extends from the junction of the Nangor Road and the Ninth Lock Road southward for 147 metres (approx.) and westward for 100 metres (approx.) in the Townland of Clondalkin in the County of Dublin.
