NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO.2) ACT, 1960, AND AMENDED BY SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT, 2000, ROADS ACTS, 1993 – 2001, LOCAL GOVERNMENT ACTS, 1925 – 2003, SECTION 11 OF THE LOCAL GOVERNMENT ACT, 2001, AND THE PLANNING AND DEVELOPMENT ACTS, 2000 – 2002, TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4(a) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS, 2000 - 2002.

COMPULSORY ACQUISITION OF LAND.
South Dublin County Council Compulsory Purchase (Nangor Road Improvement Scheme) Order, 2006.
 
South Dublin County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by Section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by Section 10 of the Local Government (No. 2) Act, 1960 as substituted by Section 86 of the Housing Act, 1966 and as amended by the Planning and Development Acts, 2000 - 2002 and the Local Government Act, 2001, have made an order entitled as above which is about to be submitted to An Bord Pleanála (hereinafter “the Board”) for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the land described in the Schedule hereto for the purposes of the construction of a road improvement scheme, and all ancillary works associated therewith, from the Townland of Ballybane to the Townlands of Milltown and Grange, commencing at the Nangor Road west of Kilcarberry roundabout and concluding at the R120 Lucan/Newcastle Road west of the Nangor Road, County Dublin and traversing the Townlands of Ballybane, Milltown, Kilcarberry, Clutterland and Grange, all in the County of Dublin.

Owners, lessees and occupiers of the land described in the Schedule will receive individual written notice.

The Order will also authorise the local authority to extinguish the public right of way described in the Second Schedule hereto, by order made by them after they have acquired the land, where the said public right of way is over the land so acquired or any part thereof, or over land adjacent to or associated with the land so acquired or any part thereof. Any objections to the extinguishing of the said public right of way should be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, to be received before Friday, 28th April, 2006.

The Board cannot confirm
 a)   a compulsory purchase order in respect of the land if an objection is made in respect  of the acquisition by an owner, lessee or  
          occupier of the land, and not withdrawn,
 b)   an order which authorises the extinguishment of a public right of way if there is an objection to the extinguishment,
          which is not withdrawn,

until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who held the oral hearing. A copy of the order and of the map referred to in it may be seen at all reasonable hours at South Dublin County Council, County Hall, Town Centre, Tallaght, Dublin 24, and also Civic Offices, Ninth Lock Road, Clondalkin, Dublin 22, and Lucan Library, Superquinn Shopping Centre, Newcastle Road, Lucan Co. FIRST SCHEDULE
Land other than land consisting of a house or houses unfit for human habitation and  not capable of being rendered fit for human habitation at reasonable expense. The land to which the order refers is bounded by a line drawn along the existing Nangor Road (R134) west of Kilcarberry roundabout and concluding at the R120 Lucan/Newcastle Road west of the Nangor Road, County Dublin and traversing the Townlands of Ballybane, Milltown, Kilcarberry, Clutterland and Grange, all in the County of Dublin.

SECOND SCHEDULE
 Description of public rights of way proposed to be extinguished. That section of the Regional Road R120, Lucan/Newcastle Road, in the townlands of  Clutterland and Grange, and in the Electoral Divisions of Clondalkin-Dunawley and Newcastle in the County of Dublin and between the lines A-A and B-B, shown on the Drawing No. MDT0161DP0001 Sheet 1 of 3 of the Deposited Maps.
That section of the Regional Road R134, Nangor Road, in the townlands of Milltown, Kilmactalway and Clutterland, and in the Electoral Divisions of Clondalkin-Dunawley and Newcastle in the County of Dublin and between the lines C-C and D-D, shown on the Drawing No. MDT0161DP0002 Sheet 2 of 3 of the Deposited Maps.
That section of the Regional Road R134, Nangor Road, in the townlands of Ballybane and Milltown, and in the Electoral Divisions of Clondalkin-Dunawley and Clondalkin Village in the County of Dublin and between the lines E-E and F-F, shown on the Drawing No. MDT0161DP0002 Sheet 2 of 3 of the Deposited Maps.
That section of the Right of Way, in the townland of Ballybane, and in the Electoral Division of Clondalkin-Dunawley in the County of Dublin and between the lines Y-Y and Z-Z, shown on the Drawing No. MDT0161DP0003 Sheet 3 of 3 of the Deposited Maps.
