NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO.2) ACT, 1960, TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4(a) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS, 2000 - 2002.

 

COMPULSORY ACQUISITION OF LAND.

South Dublin County Council Compulsory Purchase (Finnstown) Order, 2004.

 

South Dublin County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by Section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by Section 10 of the Local Government (No. 2) Act, 1960 as substituted by Section 86 of the Housing Act, 1966 and as amended by the Planning and Development Acts, 2000 - 2002 have made an order entitled as above which is about to be submitted to An Bord Pleanála (hereinafter “the Board”) for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the land described in the Schedule hereto for the purposes of facilitating the upgrade of Lock Road (R120 Newcastle to Lucan Road) which involves the widening of 205 metres of single carriageway 6-metres in width of single-carriageway of 6-metre width to 9-metre width, the construction of a footpath on both sides, provision of public lighting, a new surface water drainage system and other related works.

 

The proposed upgrade of the R120 Newcastle Road is also required as specified in modification No.2 of the decision of An Bord Pleanala to approve the Planning Scheme made by South Dublin County Council under Section 169 of the Planning and Development Act, 2000 pursuant to an order entitled “The Planning and Development Act, 2000 (Designation of Strategic Development Zone – Adamstown Lucan) Order, 2001” (S.I. No. 272 of 2001).

 

Owners, lessees and occupiers of the land described in the Schedule will receive individual written notice.

The Board cannot confirm a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who held the oral hearing.

Schedule

PART 1.

Land other than land consisting of a house or houses unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense.

 

The area to which the Order relates is bounded by a line drawn on the existing Lock Road (R120 Newcastle to Lucan Road) between Finnstown Cloisters and Finnstown Priory.
