NOTICE OF THE CONFIRMATION BY SOUTH DUBLIN COUNTY COUNCIL OF A COMPULSORY PURCHASE ORDER MADE UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960 AS RESPECTS ALL OR PART OF THE LAND TO WHICH THE COMPULSORY PURCHASE ORDER RELATES TO BE PUBLISHED IN ACCORDANCE WITH SECTION 78 (1) OF THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS, 2000 - 2002

SOUTH DUBLIN COUNTY COUNCIL COMPULSORY PURCHASE (OUTER RING ROAD-ADAMSTOWN ROUNDABOUT TO N4) ORDER 2003
South Dublin County Council has, on 6th July,2004 made a confirmation order confirming without modification the above-named compulsory purchase order as respects the land described in the Schedule-Part 1 hereto. The said order, as so confirmed, authorises South Dublin County Council to acquire the said land compulsorily. It will become operative three weeks from the date of publication of this notice. A copy of the order as so confirmed and of the map referred to in it may be seen at all reasonable hours at the offices of South Dublin County Council, County Hall, Town Centre, Tallaght, Dublin 24. A copy of the Order as so confirmed and of the map referred to in it is also available on the South Dublin County Council Website – www.southdublin.ie.
The Order also authorises the local authority to extinguish the public right of way described in the Schedule – Part II hereto, by order made by them after they have acquired the said land.
An application for judicial review of the decision of the Council under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986) may be made to the High Court within eight weeks of the date of publication of this notice in accordance with section 50 of the Planning and Development Act, 2000.
SCHEDULE – PART I
Land other than land consisting of a house or houses unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense.
The area to which the Order relates is bounded by a line drawn from the Adamstown Roundabout, currently under construction, eastward to the Fonthill Road and from the Adamstown Roundabout northward to the Old Lucan Road and includes lands situated in the Townlands of Ballydowd, Ballyowen, Balgaddy, Kishogue and Neilstown.
SCHDEDULE – PART II
Description of public right of way proposed to be extinguished.
That section of the Local Secondary Road L-5218, Lynch’s Lane, in the townland of Kishogue, and in the Electoral Divisions of Lucan Esker and Clondalkin Cappaghmore in the County of Dublin and between the lines A-A and B-B, shown on Drawing No. LA/26/03 (Sheet 4 of 6) of the deposited map.
