Re: Eviction of tenants for Rent Arrears 25 November 2005
South Dublin County Council is not in a position to make public statements in relation to individual cases. In relation to the issue of Rent Arrears generally the following sets out Council policy -

The council’s rent charge is calculated in accordance with an annual Rent Scheme. In summary, weekly rent is arrived at by calculating 10% of the weekly income of the household’s highest earner. Added to this is a contribution for each other person earning in the household. Deductions can be made in acknowledgement of particular circumstances. Tenants are required to pay their rent weekly under the terms of their tenancy agreement.
Where tenants find themselves in a position where they have fallen behind in their rent, the Council’s Rent Section is available to discuss their case and is willing to facilitate affordable arrangements for the clearance of the arrears.
Where a tenant does not pay their rent, or keep to the agreed arrears arrangement, the Council issues a series of Warning Letters advising that continued non-payment will result in legal proceedings being taken. During the course of this process, the Rents Section will try to contact the tenant in an effort to resolve the situation through correspondence, phone calls, house calls and other means.
In cases where, in spite of the best efforts of the Council, significant arrears remain, continue to accumulate and the tenant does not attempt to resolve the situation, the Council will be forced to resort to pursuing legal proceedings.
These legal proceedings are pursued only as a last resort and where all reasonable efforts to resolve the situation have been exhausted. In such cases a court order is sought for the eviction of the tenant.
